California DMV DUI License Suspension

You must contact the DMV within 10 days of your Los Angeles DUI arrest. If you have been arrested for driving under the influence in Los Angeles, you must immediately take action. You have only 10 days from the date of arrest to contact the California Department of Motor Vehicles to place a stay on the automatic suspension of your license. This action is completely independent of any action taken by the court. If you fail to contact the DMV within 10 calendar days, the DMV will automatically suspend your license thirty (30) days from the date of arrest.

Starting the DMV Process – Administrative Per Se Hearings
After an arrest for a Los Angeles DUI, the arresting agency will confiscate your driver’s license and give you a pink temporary license. The pink temporary license will last for thirty (30) days and contains your notice of a right to a hearing on the automatic suspension of your license. The pink temporary license, also known as the DS367, indicates where and how you can contact the DMV to request a hearing. It is important to note that a DMV hearing or Administrative Per Se Hearing does not take place at your local DMV branch. All administrative licensing hearings take place at specific driver’s safety branch location. The location that your hearing will be heard is based off of the area in Los Angeles that you were arrested.
